Daniel's Mobile Mechanic Service Agreement & Liability Waiver
This Service Agreement and Liability Waiver (“Agreement”) is entered into between Daniel’s Mobile Mechanic (“Service Provider”) and the undersigned client (“Client”).
By authorizing services, Client agrees to the terms below:
Daniel’s Mobile Mechanic provides mobile automotive diagnostic, maintenance, repair, and inspection services at the Client’s requested location. Services are limited to those authorized verbally, electronically, or in writing by the Client. There will be a minimum non-refundable diagnostic fee of $75 required before any service is provided. If the Client proceeds to approve the repair, the fee will be applied toward the total cost of services.
Client authorizes Daniel’s Mobile Mechanic to:
Inspect, diagnose, and/or repair the vehicle listed
Operate the vehicle as necessary for testing and road checks
Use replacement parts (OEM, aftermarket, or customer-supplied if approved)
Customer understands that verbal or electronic approval constitutes authorization under Florida law.
Estimates are good-faith estimates, not guaranteed prices
Final cost may change if additional issues are discovered
Payment is due upon completion of services unless otherwise agreed
Accepted payment methods: Cash, Zelle, or Cash App
Failure to pay may result in legal collection remedies permitted under Florida law.
Diagnostic services identify likely causes, not guaranteed fixes.
Client understands:
Some issues may require further testing
No diagnostic guarantees complete resolution
No refunds for diagnostic time once performed
Parts warranties are limited to the manufacturer’s warranty
Labor warranty (if offered) applies only to workmanship, not parts failure
No warranty applies to:
Client-supplied parts
Pre-existing conditions
Failures unrelated to performed services
Client acknowledges:
Vehicle may have hidden, prior, or unrelated defects
Daniel’s Mobile Mechanic is not responsible for failures caused by:
Wear and tear
Corrosion
Prior repairs
Manufacturer defects
To the fullest extent permitted by Florida law, Daniel’s Mobile Mechanic shall not be liable for:
Loss of use
Towing costs
Rental vehicles
Lost income
Incidental or consequential damages
Liability, if any, is limited to the amount paid for the specific service performed.
Client agrees to:
Provide safe access to the vehicle
Ensure vehicle is legally parked
Disclose known issues and prior repairs
Keep pets and bystanders clear during service
Service may be refused or stopped if conditions are unsafe.
Client understands that automotive repair involves inherent risks.
Client voluntarily assumes all risks associated with:
Vehicle condition
Mechanical failure
Testing and operation
Client releases and holds harmless Daniel’s Mobile Mechanic from claims arising from:
Pre-existing defects
Component failure unrelated to performed work
Normal mechanical risks
This waiver applies to the maximum extent allowed under Florida law.
Client agrees to indemnify and hold harmless Daniel’s Mobile Mechanic from claims arising from:
Client negligence
Inaccurate vehicle information
Unsafe service location conditions
This Agreement shall be governed by the laws of the State of Florida.
Any disputes shall be resolved in a Florida court of proper jurisdiction.
This Agreement constitutes the entire understanding between the parties and supersedes prior agreements.
If any provision is found unenforceable, the remaining provisions shall remain in effect.
This pre-purchase inspection is a limited visual and functional evaluation of the vehicle at the time of inspection. It is not a guarantee or warranty of the vehicle’s condition, reliability, or future performance.
Daniel’s Mobile Mechanic does not disassemble components, remove covers, or perform invasive testing unless specifically authorized and paid for separately.
The inspection:
Reflects the condition of the vehicle only at the time of inspection
Is based on visible, accessible, and observable conditions
May not reveal hidden, intermittent, internal, or future mechanical failures
The following may not be detected during a pre-purchase inspection:
Internal engine or transmission damage
Electrical faults that are intermittent or not currently active
Issues that develop after inspection
Prior accident or flood damage not visibly apparent
Manufacturer defects or recalls
Problems masked by temporary repairs or cleared diagnostic codes
A diagnostic scan checks for current and stored fault codes only.
The absence of diagnostic trouble codes does not guarantee the absence of mechanical or electrical issues.
Daniel’s Mobile Mechanic makes no guarantees regarding:
Roadworthiness
Emissions compliance
Passing state inspection
Longevity of components
Suitability of the vehicle for purchase
All findings are informational only and intended to help the client make an informed decision.
By authorizing a pre-purchase inspection, the client acknowledges and agrees that:
The inspection is not exhaustive
The inspection does not replace a full mechanical teardown
Daniel’s Mobile Mechanic is not responsible for undiscovered or future issues
Final purchase decisions are made solely by the client
